Kyatchi Carbon respects your privacy and only collects the information needed to respond to enquiries, process orders, complete custom work, carry out repairs, and run the business.

1. Information we collect

We may collect your name, email address, phone number, billing or delivery address, vehicle details, photos, measurements, order details, payment related information, enquiry messages, and basic website usage information such as cookies and analytics data.

2. How we use your information

We use your information to respond to enquiries, provide quotes, process orders and payments, arrange pickup or delivery, complete custom work or repairs, confirm fitment details, provide customer support, keep business records, improve our website and services, and meet legal obligations.

If you subscribe to updates, we may send occasional product or workshop updates. You can unsubscribe at any time.

3. Photos and project content

We may take photos or videos of vehicles, parts, repairs, and finished work for customer updates, records, website content, social media, and marketing.

We will take reasonable steps not to publish private customer details, addresses, number plates, or identifying information without permission. If you do not want your vehicle or project shown publicly, please let us know.

4. Sharing your information

We do not sell personal information.

We may share information where needed with payment providers, website platforms, freight companies, accounting software, suppliers, contractors, service providers, or where required by law. Some of these services may store or process information outside Australia.

5. Security and access

We take reasonable steps to protect personal information from misuse, loss, unauthorised access, modification, or disclosure.

Terms and Conditions

These Terms and Conditions apply when you use the Kyatchi Carbon website, purchase a product, request a quote, place an order, or engage us for custom carbon fibre work, carbon fibre repair, fitment, or related services.

By using our website, placing an order, or engaging our services, you agree to these Terms and Conditions.

1. Quotes and pricing

All prices are listed in Australian dollars.

Prices may include or exclude GST depending on how they are shown on the website, invoice, or quote. Where GST applies, it will be shown clearly.

Quotes are valid for the period stated on the quote. If no period is stated, quotes are valid for 14 days.

A quote may change if the scope of work changes, the customer provides new information, extra work is required, or the job is different from what was originally described.

2. Orders and deposits

Some products or services may require a deposit before work begins.

For custom work, design work, repairs, or made to order products, the deposit may be used to cover design time, materials, scheduling, supplier costs, and work already completed.

Deposits are not refundable once work has started, materials have been ordered, or production has been scheduled, except where required by Australian Consumer Law.

The remaining balance must be paid before pickup, delivery, installation, or release of the completed product.

3. Custom work

Custom carbon fibre parts, repairs, and made to order products are produced based on the information, vehicle details, measurements, photos, scans, drawings, approvals, or instructions provided by the customer.

The customer is responsible for providing accurate information and confirming that the requested product or service is suitable for their vehicle, use case, class rules, event rules, and intended purpose.

Custom work may involve design changes, fitment adjustments, trimming, sanding, finishing, or further work as the project develops. We will communicate major changes where practical.

4. Lead times

Lead times are estimates only.

Custom carbon fibre work, repairs, manufacturing, supplier delays, freight delays, vehicle access, curing times, workshop schedule, and unexpected issues may affect completion time.

We will make reasonable efforts to complete work within the estimated timeframe, but we are not responsible for delays outside our reasonable control.

5. Fitment and installation

Some products may require professional installation, adjustment, trimming, drilling, brackets, supports, fasteners, or vehicle specific modification.

Unless installation is included in the quote or invoice, the customer is responsible for fitting the product correctly and safely.

For motorsport, track, off road, or high load applications, proper mounting, support, inspection, and maintenance are critical. The customer is responsible for ensuring the part is installed and used safely.

6. Motorsport and track use

All Kyatchi Carbon products are intended for off road, track, motorsport, competition, or display use only.

Our products are not represented as being approved, certified, or legal for use on public roads. The customer is responsible for checking whether a product is suitable and legal for their intended use, including road use, track use, competition rules, class regulations, registration requirements, engineering requirements, and insurance requirements.

Motorsport and track use involves risk. Parts may be exposed to high loads, vibration, kerb strikes, heat, impact, poor road surfaces, incorrect installation, or misuse.

The customer is responsible for ensuring the product is installed, supported, inspected, maintained, and used safely.

7. Returns and cancellations

Standard products may be returned where required under Australian Consumer Law.

We do not accept returns for change of mind on custom made, made to order, modified, installed, used, or specially ordered products, unless required by law.

Custom orders may not be cancelled once work has started, materials have been ordered, or production has been scheduled, except where required by Australian Consumer Law.

If a customer cancels an order after work has started, we may retain part or all of the deposit or charge for work already completed, materials ordered, supplier costs, and reasonable administration time.

8. Australian Consumer Law

Nothing in these Terms and Conditions excludes, restricts, or modifies any rights you may have under Australian Consumer Law or any other law that cannot be excluded.

Our goods and services come with guarantees that cannot be excluded under Australian Consumer Law.

If a product or service has a major failure, you may be entitled to a repair, replacement, refund, cancellation, or compensation depending on the circumstances. If the failure is not major, we may be entitled to provide a repair or replacement within a reasonable time.

9. Damage, wear, and misuse

We are not responsible for damage caused by incorrect installation, misuse, impact, accidents, track incidents, kerb strikes, poor maintenance, modification by others, excessive loads, unsuitable mounting, or use outside the intended purpose.

Carbon fibre parts should be inspected regularly, especially after track use, impact, or hard contact.

10. Shipping and delivery

Where shipping is arranged, delivery times are estimates only.

Risk in the goods passes to the customer once the goods are collected, delivered, or handed to a courier or freight provider, except where the law provides otherwise.

The customer must inspect delivered goods as soon as possible and notify us promptly if an item arrives damaged.

11. Website information

The information on our website is provided for general information only.

We make reasonable efforts to keep product information, pricing, photos, descriptions, and availability accurate, but errors may occur.

We may update website content, pricing, products, and services at any time without notice.

12. Intellectual property

All website content, product designs, photos, videos, branding, drawings, CAD work, renders, and other materials created by Kyatchi Carbon remain the property of Kyatchi Carbon unless agreed otherwise in writing.

Customers must not copy, reproduce, modify, distribute, or use our designs, content, or materials without written permission.

13. Liability

To the maximum extent permitted by law, Kyatchi Carbon is not liable for indirect loss, loss of profit, loss of opportunity, vehicle downtime, event entry costs, travel costs, or other consequential loss arising from the use of our products or services.

Kyatchi Carbon is not responsible for accidents, vehicle damage, injury, loss, or other damage caused by incorrect installation, unsuitable mounting or support, misuse, modification by others, impact, track incidents, kerb strikes, poor maintenance, failure to inspect parts, or use outside the product’s intended purpose.

The customer is responsible for ensuring all products are installed, supported, inspected, maintained, and used safely.

Nothing in this section limits any rights you may have under Australian Consumer Law.

14. Changes to this page

We may update this Privacy Policy and Terms and Conditions from time to time. The latest version will be published on our website.
